Purpose
In the Netherlands, there is a practice of entrepreneurs who buy land, fragment it into tiny parcels and sell it using aggressive marketing campaigns for extremely high prices to private people suggesting that this is a fine investment, because of expected planning gain. However, usually, this land has no prospect for development at all being often situated in areas that have no development perspective at all. Furthermore, the speculative shredding of land makes it unfit for future uses. This paper aims to explore whether the legal systems of Nordic countries (Denmark, Finland, Norway and Sweden) with regard to subdivision, can help to address this issue of speculative land fragmentation, and it explores the potential of Nordic experiences for including some of these principles in the legal system of the Netherlands.

Design/methodology/approach
The comparative study is based on study of relevant documents and legal materials, studies and expert interviews.

Findings
Denmark, Norway and Sweden have each a system that will not allow speculative land fragmentation in the ways it appears in the Netherlands. The way these systems are organised differs, with a central role of a private surveyor (Denmark), the municipality (Norway) or a national agency (Sweden). Finland has a system that will not prevent subdivision outside areas that are planned for construction.

Practical implications
Different alternative ways are discussed on how the experiences from the Nordic countries can be used to change the Netherlands system.

Originality/value
The speculative land fragmentation in the Netherlands is a rather new phenomenon and there is no previous publication on the ways how learning from Nordic countries may provide options to prevent it.

Gebiedsontwikkeling is nu vaak te traag en te duur. Deze problematiek wordt in niet onbelangrijke mate veroorzaakt doordat de verwervingsprijs van ruwe bouwgrond in de achter ons liggende jaren aanzienlijk is gestegen. Dat levert niet alleen een belemmering op voor het actief grondbeleid van gemeenten. Het zorgt er ook voor dat er maar beperkt financiële ruimte is voor kostenverhaal. Niek van der Heiden, Fred Hobma en Herman de Wolff laten zien hoe in het buitenland de waardesprong van grond soms (gedeeltelijk) tóch in publieke handen terecht kan komen.

This report has been compiled as part of the EU Horizon 2002 financed project RURALIZATION on ‘The opening or rural areas to renew rural generations, jobs and farms’ and have been prepared by members of the protect team. Access to land is one of the topics, which is addressed by considering, (1) legal and policy arrangements, (2) land holdings and land markets and (3) current and novel initiatives that provide access to land. The current report provides an overview of legal and policy arrangements in the EU Member States (including the UK) based on the work of national reporters2 who have, based on a questionnaire, provided information on the situation in different Member States. By this method a broad overview is provided. However, reporters may not always be aware of all initiatives in a member state over the whole width of relevant legal and policy arrangements, which means that certain relevant aspects may be missed. Issues that are addressed are the land tenure system, the public protection of farmland and a range of direct and indirect policy instruments.

Access to land is one of the main issues faced by new generations in rural areas. The RURALIZATION project addresses this topic by analysing (Loveluck et al., 2021) and developing (in progress) innovative practices, studying land holdings and land market trends (Korthals Altes, 2021) and by studying legal and policy arrangements regarding access to land. Results will be discussed in focus group discussions. The legal and policy arrangements are studied both by a general overview of the situation in all EU Member states (Korthals Altes and de Wolff, 2021) and by an in depth qualitative analysis of 8 selected legal and policy arrangements (this report) with the objective to find out how these legal and policy arrangements may contribute to ensuring access to land for rural newcomers and new entrants into farming.

Op 22 maart 1977 viel het kabinet-De Uyl over de ‘wetsvoorstellen inzake de grondpolitiek’. De hedendaagse variant van die wetsvoorstellen, de Aanvullingswet grondeigendom Omgevingswet, heeft duidelijk een minder grote politieke impact, maar de juridische consequenties van die nieuwe wetgeving zijn veel groter. Op het terrein van onteigening, de voorkeursrechten, de landinrichting en het kostenverhaal worden aanzienlijke veranderingen – zelfs stelselwijzigingen – voorgesteld. Reden genoeg om die vier aspecten van de Aanvullingswet grondeigendom Omgevingswet door vier scherpe geesten kritisch te laten beschouwen, en dat is precies wat er op de aanstaande jaarvergadering zal gebeuren

Op 1 februari 2019 is de Aanvullingswet grondeigendom Omgevingswet aan de Tweede Kamer aangeboden. Het wetsvoorstel bevat onder andere de opvolging van de afdeling Grondexploitatie zoals nu in de Wet ruimtelijke ordening is opgenomen. Wat is nu het wettelijk kader voor kostenverhaal rond de grondexploitatie?2 Hoe zit de nieuwe regeling in elkaar? Wat zijn de verschillen met de huidige regeling en wat kunnen de consequenties zijn voor de praktijk? Dat zijn de zaken die in onderstaande bijdrage kort de revue passeren. Het accent ligt daarbij op het in beeld brengen van het gekozen systeem.

In dit artikel wordt ingegaan op de positie van grondexploitatie in het debat rond overheid en marktactiviteiten. Er wordt ingezoomd op het Besluit begroting en verantwoording provincies en gemeenten en de betekenis van de recente wijzigingen. Daarbij staat de vraag centraal of gemeenteraden nu beter grip hebben op grondexploitatie.

Dit onderzoek maakt deel uit van het onderzoeksprogramma ‘Woningmarktonderzoek aardbevingsgebied Groningen’. Op initiatief van de Dialoogtafel Groningen wordt door OTB – Onderzoek voor de gebouwde omgeving een onderzoek uitgevoerd naar de volgende vraag: "Wat zijn de actuele en geprognotiseerde gevolgen van de aardbevingen voor de karakteristieken van de woningmarkt en het woondomein in het Groninger aardbevingsgebied?”
